This really nice man is sitting across from me in my office and says that has been sued “a few times” and he didn’t do anything about it. Now he is wondering why his bank account has been drained and his checks are bouncing more than LeBron James bringing the ball up the court.
I did some investigating and found out that yes, he had been sued, and also yes, there were judgments against him. But what does that mean?
It means that he can lose stuff. Stuff like possessions, like a car or a motorcycle, and of course, money. And where will the creditor get that money? Directly out of his bank account, as they did here.
There are limitations, of course. If you have a bank account or a vehicle or other property, including real estate, that has always been held jointly in yours and your current spouse’s names, that account can be reached by someone with a judgment against both of you but cannot be seized by someone who only has a judgment against one of you.
There are other exceptions, but those judgments can hang around forever, so wouldn’t it make sense to do something about it?
